I had the privilege (as many others) of listening to the judgment. The reasons for dismissing the petitions were very valid indeed and so will make it impossible to sustain a successful appeal (if any). It is hard to believe that Counsel of that caliber could make such perceptible mistakes as not pleading certain facts on which evidence was subsequently led and vice versa or that affidavits were sworn before Counsel having charge of the matter(section 83 of the Evidence Act is so clear on this issue). As a result of these errors, the victory was one based strictly on technicalities and not the merits of the cases. Two things readily come to mind- 1. either the mistakes were intentional(I want to believe so) and 2.always give work to a third party for review- in other words get a second opinion before finalizing (for a myriad of reasons). On the whole, 1. I commend the justices for such an analytical, sound and erudite judgment. 2. I also commend the lawyers for their intelligent submissions, unpardonable mistakes regardless.
